the constitution

nowhere in the constitution or in the bill of rights does it say that these rights we have as human beings only apply to us citizens. they apply to all. So enemy combatants, Mexicans, and yes, even Iraqis have all the rights of the constitution. NO MATTER where. The US government MUST always treat ALL people this way.

I think it is time for the supreme court, the congress, the president, the media to make that clear. not just citizens, everyone.

But do human rights apply to people who are not "persons" (per the US Court of Appeals)?

It's pretty clear the U.S. Constitution does not apply to the entire world. The Preamble expressly states that the Constitution is ordained and established "for the United States of America." The Framers were concerned with establishing a self-government and securing their rights - the rights of the people who would be governed under this document. It is sufficiently clear that where "the People" is used, it means "the People of the United States" - again, see the Preamble ("We the People of the United States of America ... do ordain and establish this Constitution ....").

It is absurd to suggest that the Framers meant to include enemies in "the People" who were guaranteed rights such as due process.
